THIS MATTER comes before the Court for entry of final judgment under the trust provisions of the Perishable Agricultural Commodities Act, 7 U.S.C. 499e(c), for the reasons set forth in the Court’s Memorandum Opinion and Order of December 19, 2013, and there being no just reason for delay, the Court now enters judgment pursuant to Federal Rule of Civil Procedure 54(b): ORDERED, ADJUDGED AND DECREED that Judgment is hereby entered as follows: a). Judgment is hereby entered in favor of Midwest Marketing Company, Inc. and against Quality Produce Suppliers, Inc. in the principal amount of $165,963.58, plus interest of $8,161.77 calculated through August 31, 2013 at the Illinois state rate of 5% per annum, for a total judgment amount of $174,125.35, plus post-judgment interest and costs; b). Judgment is hereby entered in favor of Ruby Robinson Co., Inc. and against Quality Produce Suppliers, Inc., in the principal amount of $13,524.20, plus contract interest of 1 Dockets.Justia.com $2,394.34, calculated through August 31,2013 at the rate of 18%, for a total judgment amount of $15,918.54, plus post-judgment interest and costs; c). Judgment is hereby entered in favor of Bushmans Inc. and against Quality Produce Suppliers, Inc., in the principal amount of $21,745.97, plus contract interest of $3,849.93, calculated through August 31,2013 at the rate of 18%, for a total judgment amount of $25,595.90, plus post-judgment interest and costs; d). Judgment is hereby entered in favor of H.C. Schmieding Produce Co. Inc. and against Quality Produce Suppliers, Inc., in the principal amount of $14,509.81, plus contract interest of $2,568.83, calculated through August 31,2013 at the rate of 18%, for a total judgment amount of $17,078.64, plus post-judgment interest and costs; and e). Judgment is hereby entered in favor of Great Lakes Produce & Marketing, LLC and against Quality Produce Suppliers, Inc., in the principal amount of $44,754.43, plus contract interest of $5,282.25, calculated through August 31,2013 at the rate of 18%, for a total judgment amount of $50,036.68, plus post-judgment interest and costs.
