The Court assumes ultimate responsibility for the erroneous developments in this case and apologizes for those errors. At the time, all parties, counsel, and the Court were making a good faith effort to resolve serious issues concerning the treatment of severely mentally ill inmates within IDOC. However, for the reasons stated above, the Court must ORDER that this action be DISMISSED WITH PREJUDICE with respect to the claims em bodied in the Consent Decree and DISMISSED WITHOUT PREJUDICE for lack of subject matter jurisdiction with respect to the newly added claims embodied in the Fifth Amended Complaint, with each party to bear its own costs.
