Court Description: ORDER granting in part and denying in part Defendant's Motion to Compel and Motion to Dismiss 12 and denying Plaintiff's Motion to Strike 21 . The parties shall, by December 28, 2010, list all opt-ins who entered into an agreement to sub mit to arbitration. As to these parties, defendant's Motion to Compel Arbitration 12 is granted. The parties, by December 28, 2010, shall also indicate which opt-ins are not subject to the arbitration agreement. If plaintiff's attorney i ntends to pursue a collective action, she shall submit, by January 7, 2011, a motion to substitute representative plaintiff.
