Pursuant to the Electronic Text-Only Order filed on December 7, 2012, adopting the Recommendation issued by the Magistrate Judge (Doc. #37) to dismiss the case without prejudice for failure to prosecute and follow the Court’s orders, it is ORDERED that the Recommendation of Magistrate Judge Hegarty (Doc. #37) is ADOPTED and the Plaintiff’s Complaint is dismissed without prejudice for Plaintiff’s failure to prosecute this action and for Plaintiff’s failure to comply with the Court’s orders, and the case is hereby closed. It is further ORDERED that the defendants AWARDED their costs, to be taxed by the Clerk of the Court pursuant to Fed. R. Civ. P. 54(d)(1) and D.C.COLO.LCivR 54.1.
