Jeff Herring, et al., 18 Defendants. ) ) ) ) ) ) ) ) ) ) Case No. C08-1489 JSW [PROPOSED] CONSENT DECREE PURSUANT TO STIPULATION 19 The Court, having read and considered the Joint Stipulation for Entry of Consent Decree that 20 21 has been executed on behalf of Plaintiffs Sanrio, Inc. and Disney Enterprises, Inc., on the one hand (collectively “Plaintiffs”), and Defendant Jeff Herring, an individual and dba The Fun Factory and 22 also dba funfactoryparties.com (“Defendant”), on the other hand, and good cause appearing therefor, 23 hereby: 24 25 ORDERS that this Consent Decree shall be and is hereby entered in the within action as follows: 1) This Court has jurisdiction over the parties to this action and over the subject matter hereof 26 pursuant to 17 U.S.C. § 101 et seq., 17 U.S.C. § 501, 15 U.S.C. § 1051 et seq., 15 U.S.C. § 1121, 27 28 28 U.S.C. §§ 1331 and 1338, and 28 U.S.C. § 1367. Herring, et al.: Stipulated Consent Decree -1- Dockets.Justia.com Case 3:08-cv-01489-JSW 1 Document 17-2 Filed 10/22/2008 Page 2 of 24 2) Disney Enterprises, Inc. is the owner of all rights in and to the copyright and trademark 2 registrations listed in Exhibits “A” and “B” attached hereto and incorporated herein by this 3 reference, and the copyrights and trademarks associated with the same. 4 5 3) Sanrio, Inc. is the owner of all rights in and to the copyright and trademark registrations listed in Exhibits “C” and “D” attached hereto and incorporated herein by this reference, and the copyrights and trademarks associated with the same. (The characters, images, trademarks and 6 7 8 9 10 11 copyrights identified in Exhibits A, B, C, and D are collectively referred to herein as “Plaintiffs’ Properties.”) 4) Plaintiffs have expended considerable resources in the creation and commercial exploitation of Plaintiffs’ Properties on merchandise such as clothing and other products, and in the enforcement of their respective intellectual property rights in Plaintiffs’ Properties. 5) Plaintiffs have alleged that the Defendant has made unauthorized uses of Plaintiffs’ Properties or substantially similar likenesses or colorable imitations thereof. 12 6) The Defendant and his agents, servants, employees and all persons in active concert and 13 participation with him who receive actual notice of the injunction are hereby restrained and 14 enjoined from: 15 16 17 a) Infringing Plaintiffs’ copyrights and trademarks in Plaintiffs’ Properties, either directly or contributorily, in any manner, including generally, but not limited to manufacturing, importing, distributing, advertising, selling, offering for sale, renting or offering to rent any unauthorized product which features any of Plaintiffs’ 18 19 Properties (“Unauthorized Products”), and, specifically: b) Importing, manufacturing, distributing, advertising, selling, offering for sale, renting 20 or offering to rent the Unauthorized Products or any other unauthorized products 21 which picture, reproduce, copy or use the likenesses of or bear a substantial 22 similarity to any of Plaintiffs’ Properties; 23 c) Importing, manufacturing, distributing, advertising, selling, offering for sale, renting or offering to rent in connection thereto any unauthorized promotional materials, 24 labels, packaging or containers which picture, reproduce, copy or use the likenesses 25 26 of or bear a confusing similarity to any of Plaintiffs’ Properties; d) Engaging in any conduct that tends falsely to represent that, or is likely to confuse, 27 mislead or deceive purchasers, the Defendant’s customers and/or members of the 28 public to believe, the actions of the Defendant, the products sold by Defendant, or the Disney, et al. v.
