ECF No. 3. I warned petitioner that failure to 20 comply with that order would result in a recommendation that this action be dismissed. Id. The 21 deadline has passed, and petitioner has neither paid the filing fee nor filed an application to 22 proceed in forma pauperis. 23 24 Accordingly, it is hereby ORDERED that the Clerk of Court shall randomly assign a United States District Judge to this case. 25 Further, it is RECOMMENDED that: 26 1. This action be dismissed for failure pay the filing fee; and 27 2.
