By order filed October 27, 2021, plaintiff was ordered to show cause, within 19 thirty days, why this action should not be dismissed for failure to identify and serve the only 20 remaining defendant. ECF No. 22. The thirty-day period has now expired, and plaintiff has not 21 shown cause or otherwise responded to the court’s order. 22 23 Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court shall randomly assign a United States District Judge to this action. 24 IT IS FURTHER RECOMMENDED that this action be dismissed without prejudice for 25 failure to identify and serve the only remaining defendant and for failure to follow court orders. 26 See Fed. R. Civ. P. 4(m); L.R. 110. 27 28 These findings and recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
