JENSEN, 15 Defendant. 16 Plaintiff is a state prisoner, proceeding pro se. Plaintiff seeks relief pursuant to 42 U.S.C. 17 18 § 1983. On August 30, 2018, plaintiff was ordered to submit a request to proceed in forma 19 pauperis under 28 U.S.C. § 1915, or to pay the required filing fees. On October 12, 2018, the 20 undersigned recommended that this action be dismissed based on plaintiff’s failure to timely 21 comply with the August 30, 2018 order. On October 29, 2018, plaintiff filed objections and 22 submitted an application to proceed in forma pauperis. Good cause appearing, the findings and 23 recommendations are vacated. Plaintiff seeks leave to proceed in forma pauperis pursuant to 28 U.S.C. § 1915. This 24 25 proceeding was referred to this court by Local Rule 302 pursuant to 28 U.S.C. § 636(b)(1). 26 //// 27 //// 28 //// 1 On January 14, 2014, in 2:12-cv-2250 WBS AC P, plaintiff was deemed to have “struck 1 2 out” pursuant to 28 U.S.C. § 1915(g).1 Judgment was final in that case well before this case was 3 filed on November 19, 2018. Furthermore, after 2:12-cv-2250 WBS AC P was commenced on 4 August 30, 2012, and before this action was commenced, plaintiff had additional cases dismissed 5 for failure to state a claim upon which relief can be granted,2 and those cases count as “strikes” 6 under § 1915(g) as well.3 7 Therefore, plaintiff is precluded from proceeding in forma pauperis in this action unless 8 plaintiff is “under imminent danger of serious physical injury.” 28 U.S.C. § 1915(g). Plaintiff 9 has not alleged any facts which suggest that he is under imminent danger of serious physical 10 injury. Thus, plaintiff must submit the appropriate filing fee in order to proceed with this action. 11 //// 12 //// 13 1 Title 28 U.S.C. § 1915(g) reads as follows: 14 In no event shall a prisoner bring a civil action . . .
