Bobbala et al Doc. 81 1 2 3 4 5 6 7 8 UNITED STATES DISTRICT COURT 9 FOR THE EASTERN DISTRICT OF CALIFORNIA 10 11 LARRY GIRALDES, JR, 12 Plaintiff, 13 14 No. 2:17-cv-002602-KJM-EFB v. ORDER M. BOBBALA, et al, 15 Defendants. 16 On March 18, 2020, this court issued a minute order, ECF No. 80, directing 17 18 plaintiff’s appointed counsel, Chijioke Ikonte, to show cause within ten (10) days why this court 19 should not deem as moot the pending Findings and Recommendations, ECF No. 69, in light of 20 the parties’ discussions at the January 27, 2020 telephonic status conference, ECF No. 78, and 21 plaintiff’s notice of withdrawal of objections to the settlement agreement, ECF No. 79. As of the date of this order, counsel has not responded. The court, therefore, 22 23 construes plaintiff’s failure to respond as a non-opposition to treating the Findings and 24 Recommendations as moot. Accordingly, the Findings and Recommendations, ECF No. 69, and 25 plaintiff’s motions addressed therein, ECF Nos. 57, 59, are MOOT. This matter is closed in its 26 entirety as previously stipulated by the parties. See ECF No. 55. 27 ///// 28 ///// 1 Dockets.Justia.com 1 2 IT IS SO ORDERED.
