MUNIZ, Warden, 15 FINDINGS AND RECOMMENDATIONS Respondent. 16 Petitioner is a state prisoner proceeding pro se with an application for writ of habeas 17 18 corpus pursuant to 28 U.S.C. § 2254, filed December 4, 2017. On December 7, 2017, this court 19 informed petitioner that, in order to proceed with this action, he must pay the $5.00 filing fee or 20 submit a completed application to proceed in forma pauperis that is approved by the court. See 21 ECF No. 3. Petitioner was provided thirty days, or until January 8, 2018, to comply with the 22 court’s order. Petitioner was informed that failure to comply with this deadline would result in a 23 recommendation that this action be dismissed. Id. at 1. The court’s deadline has passed but 24 petitioner has not complied with the court’s order or otherwise communicated with the court. Accordingly, IT IS HEREBY ORDERED that the Clerk of Court shall randomly assign a 25 26 district judge to this case; and 27 //// 28 //// 1 Dockets.Justia.com 1 IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice. 2 These findings and recommendations are submitted to the United States District Judge 3 assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
