FINDINGS AND RECOMMENDATIONS PURUSHOTTAMA SAGIREDDY, 15 Defendant. 16 17 Plaintiff is a state prisoner proceeding pro se with a civil rights action filed pursuant to 42 18 U.S.C. § 1983. By order filed May 2, 2018, the District Judge directed plaintiff to submit an 19 application to proceed in forma pauperis within thirty days. See ECF No. 14. Plaintiff was 20 “cautioned that failure to file a completed in forma pauperis application may result in the 21 dismissal of this action.” Id. at 2. The thirty-day period has expired, and plaintiff has not 22 responded to the court’s order. 23 24 Accordingly, IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice. 25 These findings and recommendations are submitted to the United States District Judge 26 assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen (14) 27 days after service of these findings and recommendations, plaintiff may file written objections 28 with the court. Such a document should be captioned “Objections to Magistrate Judge’s Findings 1 Dockets.Justia.com 1 and Recommendations.” Failure to file objections within the specified time may waive the right 2 to appeal the District Court’s order.
