Based on the United States’ motion and the files and records of the court, THE COURT 24 FINDS as follows: 25 1. This action arose out of a Verified Complaint for Forfeiture In Rem filed April 28, 2017. 26 2. The United States has moved this Court, pursuant to Local Rule 540, for entry of default 27 judgment of forfeiture against potential claimants Negus Collis, Jervaine Huie/Fenton Jermaine Huie, 28 and Michael Wallace. 1 Findings and Recommendations Dockets.Justia.com 1 3. The United States has shown that a complaint for forfeiture was filed; that potential 2 claimants Negus Collis, Jervaine Huie/Fenton Jermaine Huie, and Michael Wallace received notice of 3 the forfeiture action; that any and all other unknown potential claimants have been served by 4 publication; and that grounds exist for entry of a final judgment of forfeiture. 5 Therefore, IT IS RECOMMENDED as follows: 6 1. That Negus Collis, Jervaine Huie/Fenton Jermaine Huie, and Michael Wallace be held in 7 default; 8 2. That the United States’ motion for default judgment and final judgment of forfeiture be 9 granted; 10 3. That judgment by default be entered against any right, title, or interest of potential 11 claimants Negus Collis, Jervaine Huie/Fenton Jermaine Huie, and Michael Wallace in the defendant 12 currency referenced in the above caption; 13 4.
