By order filed May 5, 2017, the undersigned found that petitioner had failed to show cause 20 why his petition should not be dismissed for lack of habeas jurisdiction; petitioner was given 21 thirty days to file an amended complaint and convert this action to a civil rights action under 42 22 U.S.C. § 1983. ECF No. 29. Thirty days have now passed and petitioner has not filed an 23 amended complaint or otherwise responded to the order. Accordingly, the undersigned will 24 recommend that the petition be dismissed for lack of habeas jurisdiction as set forth in the May 5, 25 2017 order. 26 Accordingly, IT IS HEREBY RECOMMENDED that petitioner’s application for a writ of 27 habeas corpus be dismissed for lack of jurisdiction for the reasons set forth in the court’s May 5, 28 2017 order (ECF No. 29). 1 Dockets.Justia.com 1 These findings and recommendations are submitted to the United States District Judge 2 assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
