The matter was referred to a United States Magistrate Judge 20 pursuant to Local Rule 302(c)(1). 21 On October 11, 2012, the magistrate judge filed findings and recommendations 22 herein which were served on plaintiff and which contained notice that any objections to the 23 findings and recommendations were to be filed within fourteen days after service of the findings 24 and recommendations.
