By order filed June 6, 17 2011, the court granted plaintiff twenty-eight days to file an amended complaint. In the June 6, 18 2011 order, the court informed plaintiff of the deficiencies in his complaint. The twenty-eight 19 day period has now expired, and plaintiff has not filed an amended complaint or otherwise 20 responded to the court’s order. 21 IT IS HEREBY ORDERED that a district judge be assigned to this case. 22 IT IS HEREBY RECOMMENDED that this action be dismissed without 23 24 prejudice. See Local Rule 110; Fed. R. Civ. P. 41(b). These findings and recommendations are submitted to the United States District 25 Judge assigned to the case, pursuant to the provisions of Title 28 U.S.C. § 636(b)(l).
