FINDINGS AND RECOMMENDATIONS vs. CDCR, et al., / 16 Plaintiff, a state prisoner proceeding pro se, has filed a civil rights action pursuant 17 to 42 U.S.C. § 1983 together with a request for leave to proceed in forma pauperis pursuant to 28 18 U.S.C. § 1915. By an order filed November 16, 2010, plaintiff was ordered to file within thirty 19 days a complete in forma pauperis application together with a certificated copy of his prison trust 20 account statement for the six month period that preceded the filing of the complaint and was 21 cautioned that failure to do so would result in a recommendation that this action be dismissed. 22 The thirty day period has now expired, and plaintiff has not filed the required documents or 23 responded in any way to the court’s order. Accordingly, IT IS HEREBY RECOMMENDED that 24 this action be dismissed without prejudice. 25 26 These findings and recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
