FINDINGS & RECOMMENDATIONS / 16 By an order filed November 12, 2009, this court ordered plaintiff to complete and 17 return to the court, within thirty days, the USM-285 forms which are required to effect service on 18 the defendants. On December 23, 2009, plaintiff was granted an additional thirty days in which 19 to provide the documents. That thirty day period has since passed, and plaintiff has not 20 responded in any way to the court's order. 21 22 23 IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice. See Fed. R. Civ. P. 41(b). These findings and recommendations are submitted to the United States District 24 Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen 25 days after being served with these findings and recommendations, any party may file written 26 objections with the court and serve a copy on all parties. Such a document should be captioned 1 Dockets.Justia.com 1 “Objections to Magistrate Judge’s Findings and Recommendations.” Any response to the 2 objections shall be filed and served within fourteen days after service of the objections. The 3 parties are advised that failure to file objections within the specified time may waive the right to 4 appeal the District Court’s order. Martinez v.
