On February 19, 2010, the undersigned issued an order for petitioner to Show 19 Cause why this action should not be dismissed pursuant to the Younger abstention doctrine. 20 Plaintiff has not filed a response. 21 Accordingly, the court recommends that this action be dismissed based on 22 plaintiff’s failure to respond to the February 19, 2010 order. See Local Rule 110; Fed. R. Civ. P. 23 41(b). 24 IT IS HEREBY ORDERED that: 25 1. The August 14, 2009 (Dkt. No. 2) Motion to Proceed In Forma Pauperis be 26 vacated. 1 Dockets.Justia.com 1 2. The Clerk of the Court is directed to assign a District Judge to this case. 2 IT IS HEREBY RECOMMENDED that this action be dismissed. 3 These findings and recommendations are submitted to the United States District 4 Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
