That thirty day period has since 18 passed, and plaintiff has not responded in any way to the court’s order. 19 20 IT IS HEREBY RECOMMENDED that defendant Dix be dismissed from this action without prejudice. See Fed. R. Civ. P. 41(b). 21 These findings and recommendations will be submitted to the United States 22 District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within 23 fourteen days after being served with these findings and recommendations, plaintiff may file 24 written objections with the court.
