In the order 19 setting status conference, filed July 28, 2009, plaintiff was cautioned that this action might be 20 dismissed if service was not timely completed. This action was filed March 10, 2009 and 21 plaintiff has not yet served defendant with summons. 22 23 A status conference was held before the undersigned on December 16, 2009. Plaintiff failed to appear. It appears plaintiff has abandoned this litigation. 24 Accordingly, IT IS HEREBY RECOMMENDED that this action be dismissed. 25 These findings and recommendations are submitted to the United States District 26 Judge assigned to the case pursuant to the provisions of 28 U.S.C. § 636(b)(l).
