PARKS, et al., 15 Defendants. 16 ORDER / 17 Plaintiff, a state prisoner proceeding pro se, has filed this civil rights action 18 seeking relief under 42 U.S.C. § 1983. The matter was referred to a United States Magistrate 19 Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local General Order No. 262. 20 On May 15, 2009, the magistrate judge filed findings and recommendations herein 21 which were served on plaintiff and which contained notice to plaintiff that any objections to the 22 findings and recommendations were to be filed within twenty days. Plaintiff has filed objections 23 to the findings and recommendations. 24 In accordance with the provisions of 28 U.S.C. § 636(b)(1)(C) and Local Rule 25 72-304, this court has conducted a de novo review of this case. The findings and recommendations filed May 15, 2009, are adopted in full; 5 2. Plaintiff’s March 16, 2009, application to proceed in forma pauperis (Docket 6 No. 11) is denied; and 7 3.
