Nor has plaintiff sought leave to proceed in 22 forma pauperis or paid the requisite filing fee. See 28 U.S.C. §§ 1914(a), 1915(a). Plaintiff’s 23 request is frivolous and the court will recommend this action be dismissed. 24 Accordingly, IT IS HEREBY RECOMMENDED that plaintiff’s wholly 25 inapposite and unsupported request for a TRO be vacated and this action be dismissed as 26 frivolous. 1 Dockets.Justia.com Case 2:07-cv-02182-GEB-GGH Document 3 Filed 10/19/2007 Page 2 of 2 1 These findings and recommendations are submitted to the United States District 2 Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
