The matter was referred to a United States 18 Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local General Order No. 262. On June 17, 2009, the magistrate judge filed findings and recommendations 19 20 herein which were served on all parties and which contained notice to all parties that any 21 objections to the findings and recommendations were to be filed within twenty days. Petitioner 22 has filed objections to the findings and recommendations.1 23 1 24 25 26 In his objections, petitioner asserts that his attorney during the sanity phase of his trial failed to call certain witnesses or to present “valuable evidence.” (July 9, 2009, Objections to Magistrate Judge’s Findings and Recommendations, at 2.) To the extent petitioner is attempting to raise a new claim of ineffective assistance of counsel in his objections, this court exercises its discretion not to consider any such claim. See United States v.
