Background Plaintiff Nou Her (“Plaintiff”) is a federal prisoner proceeding pro se and in forma 22 pauperis in this civil rights action pursuant to Bivens v. Six Unknown Named Agents of Fed. 23 Bureau of Narcotics, 403 U.S. 388 (1971). 24 On June 16, 2023, the Court issued a screening order granting Plaintiff leave to file a first 25 amended complaint or a notice of voluntary dismissal within thirty (30) days. (ECF No. 6.) The 26 Court expressly warned Plaintiff that the failure to comply with the Court’s order would result in 27 a recommendation for dismissal of this action, with prejudice, for failure to obey a court order 28 and for failure to state a claim. (Id. at 7.) The deadline has expired, and Plaintiff has failed to file 1 1 an amended complaint or otherwise communicate with the Court. 2 II. Failure to State a Claim 3 A. 4 The Court is required to screen complaints brought by prisoners seeking relief against a 5 governmental entity and/or against an officer or employee of a governmental entity. 28 U.S.C. 6 § 1915A(a). Plaintiff’s complaint, or any portion thereof, is subject to dismissal if it is frivolous 7 or malicious, if it fails to state a claim upon which relief may be granted, or if it seeks monetary 8 relief from a defendant who is immune from such relief. 28 U.S.C. §§ 1915A(b). 9 Screening Requirement A complaint must contain “a short and plain statement of the claim showing that the 10 pleader is entitled to relief . . . .” Fed. R. Civ. P. 8(a)(2). Detailed factual allegations are not 11 required, but “[t]hreadbare recitals of the elements of a cause of action, supported by mere 12 conclusory statements, do not suffice.” Ashcroft v. Iqbal, 556 U.S. 662, 678 (2009) (citing Bell 13 Atlantic Corp. v. Twombly, 550 U.S. 544, 555 (2007)). While a plaintiff’s allegations are taken as 14 true, courts “are not required to indulge unwarranted inferences.” Doe I v. Wal-Mart Stores, Inc., 15 572 F.3d 677, 681 (9th Cir. 2009) (internal quotation marks and citation omitted). 16 To survive screening, Plaintiff’s claims must be facially plausible, which requires 17 sufficient factual detail to allow the Court to reasonably infer that each named defendant is liable 18 for the misconduct alleged. Iqbal, 556 U.S. at 678 (quotation marks omitted); Moss v. U.S. Secret 19 Serv., 572 F.3d 962, 969 (9th Cir. 2009). The sheer possibility that a defendant acted unlawfully 20 is not sufficient, and mere consistency with liability falls short of satisfying the plausibility 21 standard. Iqbal, 556 U.S. at 678 (quotation marks omitted); Moss, 572 F.3d at 969. 22 B. 23 Plaintiff is currently housed at FCI, Mendota, in Mendota, California, where the events in 24 the complaint are alleged to have occurred. Plaintiff names the following defendants: (1) Warden 25 FCI Mendota; (2) Dr. Moon, D.D.S., contract dental provider; and (3) Medical Director, FCI 26 Mendota. 27 28 Plaintiff’s Allegations Plaintiff alleges medical malpractice by a dental provider during tooth extraction. Specifically, Plaintiff alleges that when he arrived for a tooth extraction from FCI Mendota 2 1 Medical/Dental and Dr. Moon, he “already had his jaw wired together in 5 places from injuries 2 sustained in his [past].” (ECF No. 1 at p. 3.) Dr. Moon could not perform the “intended 3 extraction due to existing wires from the jawbone injury.” (Id.) Dr. Moon utilized a pair of wire 4 cutters and cut the wires holding Plaintiff’s jaw together. Plaintiff “revisited medical/dental 5 because . . . the tips of the cut wires were eating into [his] gums, and causing extreme pain.” (Id.) 6 Plaintiff asked Dr. Moon why he cut the wires, but Dr. Moon denied cutting them. Plaintiff 7 indicates that Dr. Moon is a private contractor, but the action occurred under “BOP contract.” 8 Plaintiff claims Dr. Moon is liable under both the contract and through his practice. 9 Plaintiff complains that he has no relief, and he soon will be released. He alleges that he is “in 10 extreme pain, at risk for infection, and cannot properly eat.” (Id.) Plaintiff contends that Dr. 11 Moon’s intentional actions were a “short cut” with no regard for Plaintiff’s health or well-being. 12 (Id.) Plaintiff contends that Dr. Moon’s actions, amounting to medical malpractice, have caused 13 him lifelong damages and pain. As relief, Plaintiff requests compensatory damages, immediate 14 treatment, and transfer to an appropriate facility. (Id. at p. 4.) 15 C. 16 For the reasons discussed below, Plaintiff’s complaint fails to state a cognizable claim for 17 18 19 Discussion relief. It does not appear that Plaintiff can cure the identified deficiencies. 1. Bivens Actions Following Ziglar v. Abbasi Plaintiff is a federal prisoner alleging that Dr. Moon, a contract dentist, failed to provide 20 him with appropriate dental care in violation of the Eighth Amendment. As he is a federal 21 prisoner, Plaintiff’s claims proceed under Bivens, 403 U.S. 388 (1971). To date, the Supreme 22 Court has only recognized a Bivens remedy in the context of the Fourth, Fifth, and Eighth 23 Amendments. See Bivens, 403 U.S. 388 (Fourth Amendment prohibition against unreasonable 24 searches and seizures); Davis v. Passman, 442 U.S. 228 (1979) (Fifth Amendment gender- 25 discrimination); Carlson v. Green, 446 U.S. 14 (1980) (Eighth Amendment Cruel and Unusual 26 Punishments Clause for failure to provide adequate medical treatment). The Supreme Court has 27 recently made clear that “expanding the Bivens remedy is now a disfavored judicial activity,” and 28 has “consistently refused to extend Bivens to any new context or new category of defendants. 3 1 Ziglar v. Abbasi, 582 U.S. 120, 137 S.Ct. 1843, 1857 (2017) (citations omitted); see Egbert v. 2 Boule, 142 S. Ct. 1793, 1803 (2022) (The Court reiterated that “recognizing a cause of action 3 under Bivens is ‘a disfavored judicial activity.’). 4 Traditionally, courts applied a two-part test to determine the appropriateness of extending 5 a Bivens cause of action. First, the Court examined whether the claim arises in a “new context” or 6 involves a “new category of defendants.” Hernandez v. Mesa, 140 S.Ct. 735, 743 (2020). 7 Second, if the claim does indeed arise in a new context, the Court assessed whether there exists 8 any “special factors counselling hesitation in the absence of affirmative action by Congress.” 9 Ziglar, 582 U.S. at 136, 137 S. Ct. at 1857 (internal quotations omitted). However, the Supreme 10 Court recently reformulated this test. In Egbert, 142 S. Ct. at 1803, the Supreme Court 11 determined that these two steps can be distilled to one single inquiry; that is, “whether there is any 12 reason to think that Congress might be better equipped to create a damages remedy.” Further, the 13 Court specified that if there is even one rational reason to defer to Congress to afford a remedy, 14 then “a court may not recognize a Bivens remedy.” Id. Practically, the Court concluded that a 15 rational reason for deference to Congress will exist “in most every case.” Id. 16 Finally, the presence of an alternative remedial structure counsels against extending 17 Bivens to a new cause of action. The Court may not even determine the adequacy of the 18 alternative remedy, as this too is a task left to Congress. Egbert, 142 S. Ct at 1807. Indeed, “[s]o 19 long as Congress or the Executive has created a remedial process that it finds sufficient to secure 20 an adequate level of deterrence, the courts cannot second-guess that calibration by superimposing 21 a Bivens remedy.” Id. This remains true “even if a court independently concludes that the 22 Government’s procedures are ‘not as effective as an individual damages remedy.’” Id. (quoting 23 Bush v. Lucas, 462 U.S. 367, 372 (1983)). 24 The Court recognizes that in Carlson v. Green, the Supreme Court found that there was an 25 available Bivens remedy for a federal prisoner’s Eighth Amendment claim for failure to provide 26 adequate medical treatment. 446 U.S. 14. Although Carlson created a Bivens remedy for certain 27 Eighth Amendment violations, Carlson did not create a blanket rule for all Eighth Amendment 28 claims brought under Bivens. See Martinez v. Bureau of Prisons, 830 F. App’x 234, 235 (9th Cir. 4 1 2020); see also Hernandez, 140 S. Ct. at 743 (“A claim may arise in a new context even if it is 2 based on the same constitutional provision as a claim in a case in which a damages remedy was 3 previously recognized.”). 4 In this district, in at least one instance, a Bivens remedy has not been extended to include a 5 plaintiff's medical indifference claim premised on dental pain and care. See Mendez v. United 6 States, No. 1:17-cv-00555-NONE-JLT (PC), 2020 WL 8513584, at *12-*14 (E.D. Cal. Mar. 24, 7 2020), report and recommendation adopted, No. 17-cv-0555-NONE-JLT (PC), 2021 WL 537271 8 (E.D. Cal. Feb. 12, 2021) (declining to extend Bivens to claims premised on dental care; 9 identifying availability of alternative remedies, including administrative grievance system, letters 10 and requests to doctor and Warden, and Federal Tort Claims Act claim for medical malpractice, 11 which counseled against extending Bivens remedy). Further, there appears to be alternative 12 remedies available, including additional visits at FCI Mendota for dental care, the administrative 13 grievance system, and, potentially, a claim for medical malpractice. 14 Additionally, Bivens remedies are not available against a private actor not directly 15 employed by the federal government. See Martinez v. Geo Grp., Inc., No. ED CV 18-1125-SP, 16 2020 WL 2496063, at *18 (C.D. Cal. Jan. 7, 2020) (“Bivens has never been applied to an 17 individual who was not in the direct employ of the federal government.”); Dubon v. GEO Corr. & 18 Detention, No. 3:18cv686-CAB-RBB, 2018 WL 4002620, at *3 (S.D. Cal. Aug. 22, 2018) 19 (explaining that the Supreme Court has refused to extend liability for constitutional violations to 20 private actors who contract with the federal government) (citing Corr. Servs. Corp. v. Malesko, 21 534 U.S. 61, 69, 74 (2001)). 22 For these reasons, the Court finds that Plaintiff’s complaint fails to state a plausible claim 23 against Defendant Moon. Even if the Court were to assume that a Bivens remedy was available, 24 Plaintiff’s complaint fails to state a cognizable claim under the Eighth Amendment against 25 Defendant Moon. 26 2. 27 28 Eighth Amendment – Deliberate Indifference A prisoner’s claim of inadequate medical care constitutes cruel and unusual punishment in violation of the Eighth Amendment where the mistreatment rises to the level of “deliberate 5 1 indifference to serious medical needs.” Jett v. Penner, 439 F.3d 1091, 1096 (9th Cir. 2006) 2 (quoting Estelle v. Gamble, 429 U.S. 97, 104 (1976)). The two-part test for deliberate 3 indifference requires Plaintiff to show (1) “a ‘serious medical need’ by demonstrating that failure 4 to treat a prisoner's condition could result in further significant injury or the ‘unnecessary and 5 wanton infliction of pain,’ ” and (2) “the defendant’s response to the need was deliberately 6 indifferent.” Jett, 439 F.3d at 1096. 7 A defendant does not act in a deliberately indifferent manner unless the defendant “knows 8 of and disregards an excessive risk to inmate health or safety.” Farmer v. Brennan, 511 U.S. 825, 9 837 (1994). “Deliberate indifference is a high legal standard,” Simmons v. Navajo Cty. Ariz., 609 10 F.3d 1011, 1019 (9th Cir. 2010); Toguchi v. Chung, 391 F.3d 1051, 1060 (9th Cir. 2004), and is 11 shown where there was “a purposeful act or failure to respond to a prisoner's pain or possible 12 medical need” and the indifference caused harm. Jett, 439 F.3d at 1096. In applying this 13 standard, the Ninth Circuit has held that before it can be said that a prisoner’s civil rights have 14 been abridged, “the indifference to his medical needs must be substantial. Mere ‘indifference,’ 15 ‘negligence,’ or ‘medical malpractice’ will not support this cause of action.” Broughton v. Cutter 16 Labs., 622 F.2d 458, 460 (9th Cir. 1980) (citing Estelle, 429 U.S. at 105–06). Even gross 17 negligence is insufficient to establish deliberate indifference to serious medical needs. See Wood 18 v. Housewright, 900 F.2d 1332, 1334 (9th Cir. 1990). 19 Here, Plaintiff does not allege that Defendant Moon was deliberately indifferent to his 20 need for an extraction or dental care. Rather, Plaintiff alleges that Defendant Moon committed 21 medical malpractice in cutting the wire in his jaw with wire cutters. As indicated above, medical 22 malpractice is not sufficient to establish deliberate indifference to serious medical needs. 23 Moreover, even negligence or gross negligence will not support an Eight Amendment claim for 24 deliberate indifference. 25 26 3. Supervisory Liability - Bivens Plaintiff also names as defendants the Warden and the Medical Director at FCI, Mendota. 27 Under Bivens, a plaintiff may sue a federal officer in his or her individual capacity for damages 28 for violating the plaintiff’s constitutional rights. See Bivens, 403 U.S. at 397. There is no 6 1 respondeat superior liability under Bivens. Iqbal, 556 U.S. at 677 (“In a § 1983 suit or a Bivens 2 action . . . the term “supervisory liability” is a misnomer.”). A government official is only liable 3 for his or her own misconduct. Id.; Starr v. Baca, 652 F.3d 1202, 1205–08 (9th Cir. 2011), cert. 4 denied, 566 U.S. 982 (2012); Serra v. Lappin, 600 F.3d 1191, 1200 (9th Cir. 2010). Plaintiff’s complaint does not include any allegations of misconduct by the Warden or 5 6 Medical Director at FCI, Mendota. Plaintiff’s complaint does not suggest that the Warden or the 7 Medical Director personally participated in or caused Plaintiff to suffer any constitutional injury. 8 III. 9 10 Failure to Prosecute and Failure to Obey a Court Order A. Legal Standard Local Rule 110 provides that “[f]ailure . . . of a party to comply with these Rules or with 11 any order of the Court may be grounds for imposition by the Court of any and all sanctions . . . 12 within the inherent power of the Court.” District courts have the inherent power to control their 13 dockets and “[i]n the exercise of that power they may impose sanctions including, where 14 appropriate, . . . dismissal.” Thompson v. Hous. Auth., 782 F.2d 829, 831 (9th Cir. 1986). A 15 court may dismiss an action, with prejudice, based on a party’s failure to prosecute an action, 16 failure to obey a court order, or failure to comply with local rules. See, e.g., Ghazali v. Moran, 46 17 F.3d 52, 53–54 (9th Cir. 1995) (dismissal for noncompliance with local rule); Ferdik v. Bonzelet, 18 963 F.2d 1258, 1260–61 (9th Cir. 1992) (dismissal for failure to comply with an order requiring 19 amendment of complaint); Malone v. U.S. Postal Serv., 833 F.2d 128, 130–33 (9th Cir. 1987) 20 (dismissal for failure to comply with court order). 21 In determining whether to dismiss an action, the Court must consider several factors: 22 (1) the public’s interest in expeditious resolution of litigation; (2) the Court’s need to manage its 23 docket; (3) the risk of prejudice to the defendants; (4) the public policy favoring disposition of 24 cases on their merits; and (5) the availability of less drastic sanctions. Henderson v. Duncan, 779 25 F.2d 1421, 1423 (9th Cir. 1986); Carey v. King, 856 F.2d 1439, 1440 (9th Cir. 1988). 26 B. 27 Here, Plaintiff’s first amended complaint is overdue, and he has failed to comply with the 28 Discussion Court’s order. The Court cannot effectively manage its docket if Plaintiff ceases litigating his 7 1 case. Thus, the Court finds that both the first and second factors weigh in favor of dismissal. 2 The third factor, risk of prejudice to defendant, also weighs in favor of dismissal, since a 3 presumption of injury arises from the occurrence of unreasonable delay in prosecuting an action. 4 Anderson v. Air W., 542 F.2d 522, 524 (9th Cir. 1976). The fourth factor usually weighs against 5 dismissal because public policy favors disposition on the merits. Pagtalunan v. Galaza, 291 F.3d 6 639, 643 (9th Cir. 2002). However, “this factor lends little support to a party whose 7 responsibility it is to move a case toward disposition on the merits but whose conduct impedes 8 progress in that direction,” which is the case here. In re Phenylpropanolamine (PPA) Products 9 Liability Litigation, 460 F.3d 1217, 1228 (9th Cir. 2006) (citation omitted). 10 Finally, the Court’s warning to a party that failure to obey the court’s order will result in 11 dismissal satisfies the “considerations of the alternatives” requirement. Ferdik, 963 F.2d at 1262; 12 Malone, 833 at 132–33; Henderson, 779 F.2d at 1424. The Court’s June 16, 2023 screening order 13 expressly warned Plaintiff that his failure to file an amended complaint would result in a 14 recommendation of dismissal of this action, with prejudice, for failure to obey a court order and 15 for failure to state a claim. (ECF No. 6, p. 7.) Thus, Plaintiff had adequate warning that dismissal 16 could result from his noncompliance. 17 Additionally, at this stage in the proceedings there is little available to the Court that 18 would constitute a satisfactory lesser sanction while protecting the Court from further 19 unnecessary expenditure of its scarce resources. As Plaintiff is proceeding in forma pauperis in 20 this action, it appears that monetary sanctions will be of little use and the preclusion of evidence 21 or witnesses is likely to have no effect given that Plaintiff has ceased litigating his case. 22 IV. 23 24 25 Conclusion and Recommendation Accordingly, the Court HEREBY ORDERS the Clerk of the Court to randomly assign a district judge to this action. Furthermore, the Court finds that dismissal is the appropriate sanction and HEREBY 26 RECOMMENDS that this action be dismissed, with prejudice, for failure to state a claim 27 pursuant to 28 U.S.C. § 1915A, for failure to obey a court order, and for Plaintiff’s failure to 28 prosecute this action. 8 1 These Findings and Recommendation will be submitted to the United States District Judge 2 assigned to the case, pursuant to the provisions of Title 28 U.S.C. § 636(b)(l). Within fourteen 3 (14) days after being served with these Findings and Recommendation, Plaintiff may file written 4 objections with the Court. The document should be captioned “Objections to Magistrate Judge’s 5 Findings and Recommendation.” Plaintiff is advised that failure to file objections within the 6 specified time may result in the waiver of the “right to challenge the magistrate’s factual 7 findings” on appeal.
