No. 10 16 17 Plaintiff, a state prisoner proceeding pro se, has filed this civil rights action seeking relief 18 under 42 U.S.C. § 1983. The matter was referred to a United States magistrate judge pursuant to 19 28 U.S.C. § 636(b)(1)(B) and Eastern District of California Local Rule 302. 20 On October 2, 2020, the magistrate judge issued findings and recommendations that 21 recommended this action be dismissed for Plaintiff’s failure to obey a court order regarding how 22 he wished to proceed with his action and failure to state a claim. Doc. No. 10. The findings and 23 recommendations were served on Plaintiff with notice that any objections to the findings and 24 recommendations were to be filed within fourteen days. Id. Plaintiff has not filed objections to 25 the findings and recommendations. 26 In accordance with the provisions of 28 U.S.C. § 636(b)(1)(C), this Court has conducted a 27 de novo review of this case.
