On November 23, 20 2016, the Court denied Plaintiff’s application to proceed in forma pauperis because he had filed 21 more than three frivolous actions in the past and did not meet the imminent danger of serious 22 physical exception of 28 U.S.C. § 1915(g) at the time this action was filed. (Doc. 7.) The Court 23 ordered him to pay the $400.00 filing fee within thirty days. (Doc. 7.) More than thirty days 24 have passed and Plaintiff has failed to make payment. 25 26 27 Based on Plaintiff’s ineligibility to proceed in forma pauperis and his failure to comply with the Court’s order to pay the filing fee in full, dismissal of this action is appropriate.
