The underlying complaint is an 19 unlawful detainer action filed by Plaintiff (“Plaintiff”). Id. 20 On October 2, 2014, United States Magistrate Judge Barbara A. McAuliffe, issued Findings 21 and Recommendations recommending this case be remanded to the Calaveras County Superior Court 22 for want for subject matter jurisdiction. (Doc. 9.) The Findings and Recommendations were served on 23 the parties and contained notice to the parties that any objections to the Findings and 24 Recommendations were to be filed within fourteen days of service of the Findings and 25 Recommendations. (Doc. 8, 5: 28.)
