Defendants argue that the notice of removal was 17 timely because no facts about Plaintiffs’ citizenship were contained within the complaint. (Doc. 11) 18 On December 3, 2010, the Magistrate Judge filed a Findings and Recommendations 19 recommending that the motion be denied because, though the notice of removal was premature at the 20 time it was filed, through the papers filed subsequently, the prematurity was cured through amendment. 21 (Doc. 14) 22 Therefore, in accordance with the provisions of 28 U.S.C. § 636 (b)(1)(C) and Britt v. Simi 23 Valley United School Dist., 708 F.2d 452, 454 (9th Cir. 1983), this Court has conducted a de novo review 24 of the case.
