O. BEREGOVSKAYA, 12 Defendant. (ECF No. 17) / 13 14 Plaintiff George Berry Strong (“Plaintiff”) is a state prisoner proceeding pro se in this civil 15 rights action pursuant to 42 U.S.C. § 1983. Defendants removed this matter from Kings County 16 Superior Court on May 7, 2009. The matter was referred to a United States Magistrate Judge 17 pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. 18 On September 1, 2011, the Magistrate Judge issued findings and recommendations 19 recommending that the federal claims be dismissed for failure to state a claim and the action be 20 remanded to Kings County Superior Court for resolution of any remaining state law claims. The 21 parties were given thirty days within which to file objections, and none were filed. 22 In accordance with the provisions of 28 U.S.C. § 636(b)(1)(C), this Court has conducted a 23 de novo review of this case. Having carefully reviewed the entire file, the Court finds the findings 24 and recommendations to be supported by the record and by proper analysis. 25 Accordingly, IT IS HEREBY ORDERED that: 26 1. The findings and recommendations, filed September 1, 2011, is adopted in full; 27 2. The federal claims in this action, are dismissed, with prejudice, based on Plaintiff’s 28 failure to state a claim upon which relief may be granted under section 1983; and 1 Dockets.Justia.com 1 3. 2 3 The Clerk of the Court is directed to remand the case to Kings County Superior Court and to close this case.
