As to all Class Members who did not timely submit requests for exclusion 4 from the settlement, all claims as alleged in the First Amended Complaint are 5 dismissed in their entirety WITH PREJUDICE. 6 3. As to all Class Members who timely submitted requests for exclusion 7 from the settlement, all claims are dismissed in their entirety WITHOUT PREJUDICE. 8 4. As to Plaintiff and all Class Members identified in Paragraph 2 above, the 9 Settlement Agreement shall be binding and enforceable, including, but not limited to, 10 the release as set forth in Section 6.2 of the Settlement Agreement. 11 5.
