The Court has jurisdiction over the subject matter of this action, 3 the Class Representatives, and the Class Members as defined in the Settlement 4 Agreement. 5 2. The Court grants final approval of class certification, for purposes 6 of settlement only, of the Class as defined in the Settlement Agreement. 7 3. The Court determines that all Participating Settlement Class 8 Members are bound by this Final Judgment. 9 4. The Court grants final approval of the Settlement Agreement, 10 which it determines to be fair, reasonable, and adequate under the 11 circumstances. 12 5. This case is dismissed with prejudice. 13 6. The Court approves the Gross Settlement Amount of $900,000 as 14 fair, reasonable and adequate. 15 7. The Court orders and directs Defendants to deposit with the 16 Settlement Administrator, by the date set forth in the Settlement, the Gross 17 Settlement Amount of $900,000, to be distributed and paid as required by this 18 Final Judgment. 19 8. The Court approves and directs the payment to Plaintiff as Class 20 Representative, by the date set forth in the Settlement, of a Service Award in 21 the amount of $6,000. 22 9. The Court approves and directs the payment to Class Counsel, by 23 the date set forth in the Settlement, of $270,000 in attorneys' fees based on an 24 award of 30% of the Gross Settlement Amount. 25 10. The Court approves and directs the payment to Class Counsel, by 26 the date set forth in the Settlement, of $30,000 in actual litigation costs and 27 expenses. 28 1 2 11. The Court approves and directs the payment to CPT Group, Inc. 3 as Settlement Administrator, by the date set forth in the Settlement, of $17,500 4 as the fees and costs of settlement administration. 5 12. The Court approves and directs the payment to the California 6 Labor and Workforce Development Agency, by the date set forth in the 7 Settlement, of $6,000 representing its 75% share of the recovery of civil 8 penalties under the Settlement attributable to the California Labor Code Private 9 Attorneys General Act of 2004, Labor Code Section 2698 et seq. 10 13. The Court approves and directs payment from the Net Settlement 11 Amount of $570,500, by the date set forth in the Settlement, in Individual 12 Settlement Payments to Participating Settlement Class Members as determined 13 by the Settlement Administrator in accordance with the terms of the 14 Settlement. 15 14. This Final Judgment shall have res judicata effect and bar 16 Plaintiff and each Participating Settlement Class Member from bringing any 17 claim, case, or action asserting any "Released Claims" as defined in the 18 Settlement. 19 15. This Court shall retain jurisdiction to enforce the terms of the 20 Settlement for one year from the date of this Final Judgment. 21 16.
