Plaintiff Ana Perez (“Plaintiff”) brought the present action against Defendant 20 Equinox Holdings, Inc. (“Defendant”) alleging (1) Disability Discrimination in Violation 21 of California Gov. Code § 12940 et seq.; (2) Failure to Accommodate Disability in 22 Violation of Gov. Code § 12940(m); (3) Failure to Engage in Interactive Process in 23 Violation of Gov. Code § 12940(n); (4) Failure to Prevent Discrimination in Violation of 24 Gov. Code § 12940(k); (5) Wrongful Discharge in Violation of Public Policy; (6) 25 Retaliation in Violation of California Government Code § 12940(h); and (7) Violation of 26 Bu. & Prof. § 17200. Prior to trial, Plaintiff abandoned her Seventh Claim for Violation 27 of Bu. & Prof. § 17200. 28 2. A jury trial in this case was held on September 2, 2021, September 3, 2021, and September 7, 2021.
