Plaintiff’s cause of action is DISMISSED without prejudice for failure to state a claim upon which relief may be granted. 3. Dismissal of this action count as a “strike” for purposes of 28 U.S.C. § 1915(g); 4. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that an in forma pauperis appeal from this Order would not be taken in good faith.
