(Doc. 48.) No objections to the report and recommendation were filed by either party. The undersigned was then randomly drawn to review the report and recommendation. Having now carefully reviewed and considered de novo all the materials in the court file, including the report and recommendation, the Court is of the opinion that the report is due to be adopted and the recommendation accepted. Consequently, the defendant’s motion for summary judgment is due to be granted and this action dismissed with prejudice.
