Cuevas v. Holder, Jr., No. 13-60150 (5th Cir. 2013)Annotate this Case
Petitioner, a native and citizen of Mexico, sought review of the BIA's conclusion that he was inadmissible because there was reason to believe that he was a drug trafficker. The court concluded that it lacked jurisdiction to consider the petition for review and dismissed the petition where a prior conviction was not required for an alien to be removable under 8 U.S.C. 1182(a)(2)(C), and where DHS has shown through reasonable, substantial, and probative evidence that petitioner was engaged in illicit trafficking.
The court issued a subsequent related opinion or order on January 20, 2014.
