PER CURIAM: Nathan Wayne Smith appeals the district court’s order accepting the recommendation of the magistrate judge and dismissing Smith’s complaint filed pursuant to the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b), 2671-2680, and denying Smith’s motion to amend. We have reviewed the record and find no reversible error. Accordingly, we affirm for the reasons stated by the district court, and we deny Smith’s motion for appointment of counsel. Smith v. United States, No. 3:19-cv-00179-GMG (N.D.W. Va. Feb. 24, 2022). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process. AFFIRMED 2
