US Court of Appeals for the Fourth Circuit - 40 F.3d 1243 (4th Cir. 1994) Submitted Sept. 26, 1994. Decided Nov. 3, 1994

Appeal from the United States District Court for the District of Maryland, at Baltimore. J. Frederick Motz, District Judge. (CA-94-2052-JFM).

Monroe Cornish, appellant Pro Se.

D. Md.

AFFIRMED.

Before ERVIN, Chief Judge, and WILKINSON and HAMILTON, Circuit Judges.

PER CURIAM:

Monroe Cornish appeals from the district court's order dismissing his 42 U.S.C. § 1983 (1988) complaint as frivolous pursuant to 28 U.S.C. § 1915(d) (1988). Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. Cornish v. Race, No. CA-94-2052-JFM (D. Md. Aug. 5, 1994). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED.
