After examining the briefs and appellate record, this panel has determined unanimously that oral argument would not materially assist the determination of this appeal. See Fed. R. App. P. 34(a); 10th Cir.R. 34.1.9. The case is therefore ordered submitted without oral argument.

Appellant John Johnson appeals an order of the district court dismissing his complaint for failure to state a claim under 42 U.S.C. § 1983. On appeal, Johnson contends that the defendants served him undercooked chicken and denied him medical attention, that the defendants denied him his right to free exercise of religion, and that the district court erred in dismissing his claims for discrimination and conspiracy without allowing discovery. We exercise jurisdiction under 28 U.S.C. § 1291, GRANT Johnson's motion to proceed in forma pauperis, and AFFIRM for substantially the reasons given by the district court. The mandate shall issue forthwith.
