US Court of Appeals for the Fourth Circuit - 941 F.2d 1207 (4th Cir. 1991) Argued: July 10, 1991Decided: August 29, 1991

Appeals from the United States District Court for the Western District of Virginia, at Roanoke.

ARGUED: Susan Hunter Woltz, MORCHOWER, LUXTON & WHALEY, Richmond, Virginia, for Appellants. Joseph William Hooge Mott, Assistant United States Attorney, Roanoke, Virginia, for Appellee.

ON BRIEF: Michael Morchower, MORCHOWER, LUXTON & WHALEY, Richmond, Virginia, for Appellant Mundy; Daniel L. Crandall, Roanoke, Virginia, for Appellant Gist; Richard Lawrence, Roanoke, Virginia, for Appellants Maurice Hagwood and Charles Hagwood. E. Montgomery Tucker, United States Attorney; Morgan E. Scott, Jr., Assistant United States Attorney, Roanoke, Virginia, for Appellee.

Before WILKINSON, WILKINS, and NIEMEYER, Circuit Judges.

PER CURIAM:

Appellants Antoine Mundy, Maurice Lewis Hagwood, Charles William Hagwood, and Eddie Lee Gist were each convicted of conspiracy to distribute cocaine in violation of 21 U.S.C. § 846 and of possession of cocaine with intent to distribute in violation of 21 U.S.C. § 841(a) (1) and (b) (1) (B) (iii). Each appellant argues that the evidence was insufficient as a matter of law to support his convictions.

We have reviewed the briefs of counsel and heard oral argument, and we conclude that there was sufficient evidence presented at trial to support appellants' convictions. The judgment of the district court therefore is

AFFIRMED.
