E.D. Va.

OPINION

PER CURIAM:

Norman G. Berg seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal, deny appellant's motion for appointment of counsel, and dismiss the appeal on the reasoning of the district court. Berg v. Murray, CA-90-1656-N (E.D. Va. Nov. 20, 1990). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

DISMISSED.
