U.S. Court of Appeals for the Fourth Circuit - 911 F.2d 722 (4th Cir. 1990) Submitted July 9, 1990. Decided July 27, 1990

Appeal from the United States District Court for the Northern District of West Virginia, at Elkins. Robert Earl Maxwell, Chief District Judge. (C/A No. 89-129-E)

Theda G. Harford, appellant pro se.

James Willoughby Martin, Jr., Bridgeport, W.V., for appellees.

N.D.W. Va.

AFFIRMED.

Before SPROUSE and WILKINS, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

Theda Harford appeals from the district court's order affirming the bankruptcy court's orders appointing a trustee in her Chapter 11 bankruptcy case. Harford attempts to raise numerous issues on appeal to this Court which were not raised before the district court and are unrelated to the bankruptcy court order appealed from. Because these issues were not raised below, they may not be raised for the first time on appeal.

Under this Court's ruling in Committee of Dalkon Shield Claimants v. A.H. Robins Co., 828 F.2d 239 (4th Cir. 1987), bankruptcy court orders appointing a trustee may be considered final and appealable. Therefore we find jurisdiction to consider this appeal under 28 U.S.C. § 158(d).

Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. Harford v. Potomac Valley Farm, C/A No. 89-129-E (N.D.W. Va. Nov. 28, 1989). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED.
