MEMORANDUM** 

The magistrate found that plaintiff received the Appeals Council's decision no later than October 29, 1986.1  Plaintiff had 60 days from that date to file an action challenging the decision. His May 27, 1987, complaint was, therefore, approximately 5 months late. The district court properly dismissed it as untimely. 42 U.S.C. § 405(g) (1982).

AFFIRMED.
