MEMORANDUM** 

Johnson, a Washington state prisoner, appeals pro se the district court's dismissal under Fed. R. Civ. P. 12(b) (6) of his civil rights action. Johnson alleges that the governor of Washington failed to comply with Wash.Rev.Stat.Ann. Sec. 43.10.090 which states that "upon the written request of the governor the attorney general shall investigate violations of the criminal laws within this state."

The district court dismissed this action for failure to state a claim. We affirm for reasons stated by the district court in its order dated August 22, 1988.

AFFIRMED.
