ORDER

In light of our disposition in the companion appeal of Pan American Co. v. Sycuan Band of Mission Indians, No. 87-6783 (9th Cir. filed Dec. 21, 1987), affirming the district court's dismissal of Pan American Company's complaint against the Band, and the parties' agreement that affirmance on the merits of 87-6783 would be dispositive of the issues raised in this appeal, we affirm the district court's order of January 19, 1988 disbursing the $80,000 in the court registry to the Band.

AFFIRMED.
