Larry Billy Cooper, Petitioner-appellant, v. David Chester; Attorney General of the State of Northcarolina, Respondents-appellees, 857 F.2d 1468 (4th Cir. 1988)

Annotate this Case
US Court of Appeals for the Fourth Circuit - 857 F.2d 1468 (4th Cir. 1988) Submitted: June 2, 1988. Decided: Aug. 8, 1988

Larry Billy Cooper, appellant pro se.

Barry Steven McNeill, Assistant Attorney General (Office of the Attorney General of North Carolina), for appellees.

Before MURNAGHAN and CHAPMAN, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

Larry Billy Cooper seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254. Our review of the record and the district court's opinion accepting the recommendation of the magistrate discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. Cooper v. Chester, CA-87-564-C-D (M.D.N.C. Mar. 17, 1988). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

DISMISSED.
