Darsell Holmes, Petitioner-appellant, v. Superintendent, Correctional Institute, Respondent-appellee, 810 F.2d 194 (4th Cir. 1987)

Annotate this Case
U.S. Court of Appeals for the Fourth Circuit - 810 F.2d 194 (4th Cir. 1987)

Submitted Dec. 17, 1986. Decided Jan. 21, 1987

Before WIDENER and CHAPMAN, Circuit Judges, and BUTZNER, Senior Circuit Judge.

Darsell Holmes, appellant pro se.

A review of the record and the district court's opinion discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. Holmes v. Superintendent, C/A No. Y-86-1099 (D. Md., May 2, 1986).
