Rhodia J. Newton, Plaintiff-appellant, v. Allyn R. Sielaff, Director of the Virginia Department Ofcorrections, Defendant-appellee, 806 F.2d 258 (4th Cir. 1986)Annotate this Case
Submitted Oct. 3, 1986. Decided Dec. 1, 1986
Appeal from the United States District Court for the Eastern District of Virginia, at Norfolk. John A. MacKenzie, District Judge. (C/A No. 85-665-N)
Rhodia J. Newton, appellant pro se.
Thomas D. Bagwell, Office of the Attorney General, for appellee.
Before WIDENER, HALL and CHAPMAN, Circuit Judges.
A review of the record and the district court's opinion accepting the magistrate's recommendation discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. Newton v. Sielaff, C/A No. 85-665-N (E.D. Va., June 6, 1986).
