Bruce Andrew Ainsley, Plaintiff-appellant, v. Toni v. Bair, Warden; Attorney General of the State Ofvirginia, Defendants-appellees, 806 F.2d 257 (4th Cir. 1986)Annotate this Case
Submitted Oct. 17, 1986. Decided Nov. 26, 1986
Appeal from the United States District Court for the Eastern District of Virginia, at Richmond. Richard L. Williams, District Judge. (C/A No. 85-846-R)
Bruce Andrew Ainsley, appellant pro se.
Robert Q. Harris, Assistant Attorney General, for appellees.
Before WIDENER, ERVIN and WILKINS, Circuit Judges.
A review of the record and the district court's opinion discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, deny appointment of counsel, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. Ainsley v. Bair, C/A No. 85-846-R (E.D. Va., Apr. 24, 1986).
