US Court of Appeals for the Second Circuit - 226 F.2d 224 (2d Cir. 1955) Submitted April 15, 1955
Decided May 12, 1955

Appeal from the United States District Court for the Southern District of New York; Sylvester J. Ryan, Judge.

Before the instant proceedings, the debtor had executed a general assignment for the benefit of creditors. More than four months later, he filed a voluntary petition in bankruptcy. The Referee ordered the assignee to file an accounting of property in his hands at the date of bankruptcy and of subsequent operations, and enjoined him from making any disbursements without prior authority of the bankruptcy court. The District Judge vacated the entire order, from which the trustee appeals.

I. Arnold Ross, New York City, for appellant.

Robert J. Blum, New York City, for appellee.

Before FRANK, MEDINA and STALEY, Circuit Judges.

PER CURIAM.

Affirmed on the opinion of Judge Ryan. 134 F. Supp. 619.
