ORDER This 20th day of December 2016, after careful consideration of the opening brief, motion to affirm, and the record on appeal, we find it evident that the judgment below should be affirmed on the basis of the Superior Court’s order, dated August 25, 2016, adopting the report and recommendations of the Commissioner.1 We will not consider arguments the appellant raises for the first time in his opening brief.2 The Superior Court did not err in denying the appellant’s first motion for postconviction relief. 1 State v.
